the thing with tdk though is that you can take away the bat costume and it's essentially not anymore a 'superhero' movie. i think there's a good chance that heath would get it, although i certainly wouldn't want him to get it on the mere merit of sentiment. the problem with tdk as a vehicle for heath's possible oscar is that there's just too many good perfomances in that film - almost so that giving an oscar to him will make it seem like a snub to the other oscar-worthy performances in tdk, especially from the oscar-proven players.
regardless, i do think heath will get nominated. at the very least for supporting actor. the guy deserves it and not just because he died. i also want to see tdk nominated in the other major categories (although they're one actress short, aren't they? ).

It's a Long shot but I think he deserves to get a nomination for Supporting Actor and not best actor

i also think he's deserving. daniel clowes got a nomination for ghost world (best adapted screenplay), so it's not impossible for a comic movie. and persepolis was also nominated for something, i think (havent read or seen it).

Heath Ledger won the supporting-actor Academy Award on Sunday for his demented reinvention of Batman villain the Joker in "The Dark Knight," becoming only the second actor to win an Oscar posthumously.
